The Division of Water Resources is holding a public hearing to solicit comments regarding proposed rule changes as a part of the triennial review of Tennessee’s water quality standards.

NOVEMBER 15

  • MMXXII-046 - Notice Requesting Public Comments on Draft Permit Actions (Individual and General NPDES Permits, State Operation Permits & Pretreatment Program).
  • NRS22.035 - Dickson County proposes impacts to three unnamed tributaries to Haley Branch, an unnamed tributary to Beaverdam Creek, and an unnamed tributary to Nails Branch near Dickson to accommodate improvements to Two Mile Road. Stream impacts will be compensated through onsite permittee responsible mitigation.
  • NRS22.234 - The Old Gainesboro Road Utility District proposes to temporarily impact 0.034 acres of wetland and four streams for the installation of a 12-inch water line via open cut trench near Thomas Road, Pippin Road, and Cumby Road in Cookeville (Putnam County). Temporary impacts will be restored to pre-existing conditions.
  • NRS22.249 - The Campbell County Highway Department proposes to install 70 feet of single-bank riprapon roadbed along Dossett Creek on Knoxville Hollow Road and 340 feet of single-bank riprap on roadbedalong Dossett Creek on Forks Grove Road to control active erosion and stabilize the roadbeds.

  • MMXXII-045 - Notice Requesting Public Comments on Draft Permit Actions (Individual and General NPDES Permits, State Operation Permits & Pretreatment Program).
  • NRS22.082 - Crews Development, LLC is proposing an 81-lot residential development in Collierville (Shelby County). Permits issued in 2021 allowed impacts to 0.23 acres of wetlands and the construction of three stormwater outfalls. In order to complete Phase 2, it is necessary to impact 0.13 acres of wetlands. Compensatory mitigation is proposed through the purchase of 0.72 wetland credits from the Rossville Farm Mitigation Bank.
  • NRS22.248 - The Campbell County Highway Department proposes to install 465 feet of single-bank stacked-rock bank armoring and remove concrete and asphalt from the streambed along an unnamed tributary to Cedar Creek to control active erosion and stabilize the roadbed.

  • NRS22.114 - Star Land Company proposes permanent impacts to 0.24 acres of wetland and 85 feet of stream, and temporary impacts to 0.06 acres of wetland and 32 feet of stream for construction of the Hunters Grove residential subdivision and associated infrastructure in Lebanon (Wilson County). Wetland mitigation will be provided through an in-lieu fee credit purchase from the Tennessee Mitigation Fund.

  • NRS21.291 - Sapp Investments, LLC proposes 0.988 acres of permanent wetland impact associated with construction of a residential subdivision and associated infrastructure in Sevierville (Sevier County). Wetland mitigation will be provided through a credit purchase from the Lick Creek Mitigation Bank.
  • NRS22.067 - Crescent Acquisitions, LLC proposes permanent impacts to 4.06 acres wetland and 177 feet of tributaries to Lytle Creek, and temporary impacts to 0.13 acres of wetland and 24 feet of stream for construction of the Manchester Farms residential subdivision and Elam Farms Parkway extension in Murfreesboro (Rutherford County). Wetland mitigation will be provided through an in-lieu fee credit purchase from the Tennessee Mitigation Fund and on-site permittee responsible mitigation.
  • NRS22.194 - Corey Roberts proposes to construct a concrete boat ramp and riprap (13 feet by 20 feet) on the South fork Holston River in Bristol (Sullivan County). The ramp is designed to extend three feet into the channel during normal pool elevations

  • NRS22.088 - Griffin Partners, Inc. proposes to impact 1,400 linear feet of four unnamed tributaries to South Fork Cedar Creek, 0.18 acres of three unnamed palustrine emergent wetlands, and 0.30 acres of open water pond near Lebanon (Wilson County) for development of an industrial site.
  • NRS22.171 - The City of Germantown proposes installation of concrete block mat, erosion control blanket, and sod to protect erodible soils along approximately 5,000 feet of an unnamed tributary to the Wolf River (Shelby County).
  • NRS22.204 - Reelfoot Lake State Park proposes to dredge accumulated sediment from the boat channels at the Reelfoot Lake State Park visitor center and the campground boat ramp in Reelfoot Lake (Obion and Lake County) and expand the Kirby Pocket boat ramp.
  • NRS22.253 - Southshore Resort, LLC proposes to dredge approximately 350 cubic yards of silt from within the resort’s boat house embayment in Reelfoot Lake to a depth of three feet (Obion County). The purpose of the work is to ensure adequate water depth for boat access.

  • NRS22.193 - Shelby County Government proposes to repair and stabilize channel erosion that has created a scour hole on Big Creek in Millington (Shelby County). This will be accomplished by installing a sheet pile grade control structure, creating a stabilized scour hole, and re-establishing the eroded channel along 765 feet of Big Creek through the installation of articulated concrete matting and grouted riprap adjacent to the constructed scour hole. Compensatory mitigation will be provided by purchasing 318.7 functional feet credits from Rossville Farms Mitigation Bank.

  • MMXXII-040  - Notice Requesting Public Comments on Draft Permit Actions (Individual and General NPDES Permits, State Operation Permits & Pretreatment Program).
  • NRS22.214 - The USDA Forest Service proposes felling and manipulation of trees using hand equipment and heavy equipment to place trees in streams in the South Zone of the Cherokee National Forest in Monroe, Polk, and McMinn Counties. The purpose of the project is to enhance and restore fish habitat and hydraulic/floodplan function. 
SEPTEMBER 30
  • NRS22.051 - Ravago Manufacturing Americas proposes to construct a total of 209,100 square feet of building expansion on the rear of the existing Ravago industrial facility. The building expansion will be completed in three distinct segments of 69,700 square feet each. To complete the three additions will require the filling of 1.12 acres of wetland A located immediately behind the existing industrial facility. In addition, the applicant must also compensate for impacts to 0.028 acres of impact authorized under NR 2108.3313. Compensatory wetland mitigation to impact total of 1.12 acres of wetlands are proposed to be mitigated onsite with the preservation of 2.95 acres of Wetland B an Exceptional Tennessee Water and the creation of 1.86 acres. The remainder of the impacts will be compensated for at a two to one (2:1) ratio via the purchase of 1.89 credits in the primary service area of the Sequatchie Valley Wetland Mitigation Bank
  • NRS22.110 - The Tennessee Department of Transportation proposes to encapsulate or relocate 954 feet of Buffalo Creek, fill 0.25 acres of wetland and temporarily impact 0.157 acres of wetland to improve State Route 63 near Huntsville (Scott County). Stream impacts will be mitigated by purchasing 530 functional foot credits from the Cumberland River Compact Upper Tennessee Service Area. Wetland impacts will be mitigated by purchasing 0.49 credits from Roaring Paunch Mitigation Bank.
  • NRS22.122 - Welch Properties proposes 1.5 acres of permanent wetland impacts for development of a mixed-use commercial site. Wetland impacts will be offset through the purchase of 3.61 advanced credits from the Tennessee Mitigation Fund In-Lieu Fee Lower Cumberland River Service Area.
  • NRS22.144 - Hines Clari Park Holdings, LLC proposes to construct a mixed-use development on Medical Center Parkway in Murfreesboro (Rutherford County). Proposed activities require unavoidable impacts to 0.33 acres of wetland. Impacts to 0.16 acres of wetlands were previously authorized under NR2104.420. The applicant will provide compensatory mitigation for all wetland impacts through the purchase of 0.98 wetland mitigation credits from the Sandhill Wetland Mitigation Bank.
  • NRS22.170 - W.G. Investment Group, LLC purposes construction of a multi-use development fronting Houston Levee Road and Walnut Grove Road in Memphis (Shelby County). Compensation for filling 1.72 acres of wetland will be through preservation of 15.76 acres of wetland and purchase of 1.18 wetland credits from Rossville Farm Mitigation Bank.

  • NRS22.106 - The Tennessee Mitigation Fund proposes to preserve, enhance, restore and create approximately 50.71 acres of ecologically diverse bottomland hardwood forest near Lobelville (Perry County) to provide wildlife habitat, increase flood storage capacity, and improve water quality through reduced nutrient and sediment loading from surrounding land uses.
  • NRS22.146 - The West Tennessee River Basin Authority proposes use of natural channel design techniques to stabilize 1,624 feet of Sugar Creek near Middle School Street in Medina (Gibson County). Work as proposed would result in altering 1,700 feet of stream channel and adjacent riparian buffers.
  • NRS22.175 - Putnam County Schools proposes unavoidable impacts to 1.73 acres of wetland associated with the construction of a new elementary school near Lee Seminary Road. Mitigation will be provided through an in-lieu fee program credit purchase from the Tennessee Mitigation Fund’s Upper Cumberland Service Area.
  • NRS22.178 - The Tennessee Department of Transportation proposes 53.8 feet of permanent impact to McCutcheon Creek, and 0.0414 acres of permanent impact and 0.0190 acres of temporary impact to an unnamed wetland to accommodate the widening of State Route 396 and Kedron Road in Spring Hill (Maury County).
  • NRS22.195 - The Tennessee Valley Authority proposes to install 300 feet of riprap on the Tennessee River and 300 feet of riprap on the Duck River for protection of cultural resources in Humphreys County. Precise location data are confidential under the National Historic Preservation Act.

  • NRS22.206 - The Tennessee Department of Transportation proposes installation of 150 feet of shotcrete streambank stabilization along Yarnell Branch (Anderson County) in association with emergency repairs to State Route 9. Mitigation will require a minimum of 24 functional feet credits. Based on the information provided, the Commissioner determined that pursuant to rule 0400-04-07-.04, an emergency situation existed, and this permit was issued prior to public notice and participation. 
  • NRS22.215 - The Tennessee Department of Transportation proposes the following total impacts on three tributaries to Stinking Creek near Pioneer (Campbell County): armor 266 feet of stream, encapsulate 297 feet of stream, and slip-line two culverts. This work is in association with emergency repairs to I-75. Mitigation for 297 feet of encapsulation and end-wall construction and 14 feet of wingwall construction and one foot of stream length loss will require a minimum of 216.3 functional feet stream mitigation credits. Based on the information provided, the Commissioner determined that pursuant to rule 0400-04-07-.04, an emergency situation existed and this permit for remedial action was issued prior to public notice and participation.

  • NRS22.042 - Town of Oakland intends to develop a comprehensive, multi-use sports park on a 138- acre tract of land located at the northwest corner of U.S. Highway 64 and Bowers Road. Impacts includes one stream crossing, two permanent drainage outfalls into an unnamed tributary of Black Ankle Creek and Black Ankle Creek and 0.26 acres of wetland. The Town of Oakland proposes to purchase 0.52 acres of wetland credits through the West Tennessee Wetlands Mitigation Bank for site impacts. This mitigation bank is established with credits released and is located within the Primary Service Area of the project.

  • MMXXII-033  - Notice Requesting Public Comments on Draft Permit Actions (Individual and General NPDES Permits, State Operation Permits & Pretreatment Program).
  • NRS17.084 Rev 1 - Southern Land Company proposes to change the mechanism of compensatory mitigation to offset the previously authorized impacts to 0.48 acres of jurisdictional wetlands. The applicant is now required to purchase wetland mitigation credits from the Tennessee Mitigation Fund in-lieu fee program with temporal loss multipliers, as opposed to on-site wetland enhancement. All other impacts are as previously authorized under NRS17.084.
  • NRS21.129 - Thornton Grove Green, LLC proposes additional impacts associated with previously authorized impacts under NRS18.030 in the Ewing Creek watershed (Davidson County). The additional impacts for this residential development include 0.47 acres of wetland fill, 70 feet of stream impact for culvert construction, and ten feet of temporary stream impacts for utility line installation. Previous impacts were mitigated through permittee responsible mitigation and credit purchase. Additional stream and wetland impacts will be offset by credit purchases from Cumberland River Compact’s Upper Cumberland Service Area. 
  • NRS22.164 - Tim Brown proposes removal of gravel on an as-needed basis from a point bar on Flynn Creek (an Exceptional Tennessee Water) near Gainesboro (Jackson County) for use on his property.

  • NRS21.230 - Riverton Development proposes to permanently impact the Tennessee River near Lupton Drive in Chattanooga (Hamilton County) with 75 feet of rip rap bank stabilization, 3,380 feet of buffer alterations, and 0.57 acres of wetland fill for development of a mixed-use residential community. Buffer impacts will be offset onsite and wetland impacts offset through purchase of 1.2 credits from the Sequatchie Valley Wetland Mitigation Bank.
  • NRS21.291 - Sapp Investments, LLC proposes 0.60 acres of unavoidable permanent wetland impacts associated with construction and infrastructure installation for a residential subdivision near Little Cove Road in Sevierville (Sevier County). Wetland mitigation will be provided through a mitigation credit purchase from the Lick Creek Mitigation Bank.
