Salary:

The Tennessee State Board of Education (“State Board”) is seeking a full-time attorney to handle educator license discipline cases from intake of educator misconduct reports through case resolution. The Associate General Counsel/Staff Attorney will analyze educator misconduct reports and associated investigative materials, prepare discipline recommendations, draft consent orders, and represent the State Board in administrative hearings, mediations, and settlement discussions for assigned educator discipline cases. This position will work closely with other license discipline attorneys, paralegals and interns to ensure effective management of the State Board’s license discipline work. In addition, the Associate General Counsel/Staff Attorney is responsible for maintaining and building positive relationships with internal and external stakeholders to magnify and improve the Board’s licensure discipline work, and communicates with school districts, educators, law enforcement, and other stakeholders regarding license actions.

About the Tennessee State Board of Education

The State Board’s mission is to ensure policies and systems are in place so that all students are prepared for success after graduation. Job Responsibilities

  • The Associate General Counsel/Staff Attorney is responsible for the following:
  • Managing an assigned caseload of educator misconduct cases, including opening new cases reported to the State Board, analyzing investigative materials relevant to assigned case files, formulating discipline recommendations based on applicable facts, rules, and laws, and seeing cases through resolution. This includes:
  • Preparation of license action recommendations for the State Board staff case review committee and presentation of cases before this committee;
  • Docketing cases with the Secretary of State’s Administrative Procedures Division and representing the State Board at administrative hearings before an Administrative Law Judge;
  • Drafting motions, orders, discovery, and other filings;
  • Presenting and explaining license discipline recommendations to the State Board at quarterly meetings;
  • Participating in mediation and negotiating settlements when appropriate;
  • Participating in regular check-ins with the Office of Educator Licensure and Preparation (OELP) within the Tennessee Department of Education to improve inter-agency communication and problem-solving; and
  • Working with the license discipline team to refine and improve processes for management of educator misconduct cases to ensure timely resolution of all cases.
  • Conducting legal research and writing on a variety of topics relevant to license discipline and the Uniform Administrative Procedures Act.
  • Assisting drafting rules and policies relating to licensure discipline.

  • Working with other attorneys on staff to prepare and present to school districts and other interested stakeholder organizations regarding the State Board’s process for handling license discipline cases.

Qualifications

  • Strong legal research and writing skills, as well as excellent oral and written advocacy skills.

Job Description

The Tennessee Public Charter School Commission (Charter Commission) is seeking a full-time data and accountability coordinator.

The ideal candidate will have a proven ability to work with a variety of stakeholders, manage multiple projects with ambitious deadlines, and write and communicate effectively. This position is an excellent opportunity to support the Charter Commission, which was established in 2019 by the General Assembly.

The Charter Commission is comprised of nine members selected by the governor and representing a broad geographic cross-section of the state. The Commission’s focus on the authorization of quality charter schools will enable deeper engagement with local districts and stakeholders, and in turn ensure that decisions impacting students’ and families’ access to high-quality charter schools are made based on a full appreciation of communities’ specific educational needs. The Commission commenced hearing charter school appeals and reviewing charter school applications in 2021 and assumed responsibility of the authorized charter schools of the State Board of Education in the 2021-22 school year. The Commission’s school district will have 13 charter schools across two geographic districts in 2023-24 serving approximately 6,000 students.

Job Responsibilities        

Under the direction of the director of authorizing, this position will be responsible for the following:

·       Work with the director of authorizing to coordinate the annual charter school new-start appeal process including facilitation of review committees, reviewing new start applications, scheduling of capacity interviews, drafting agendas, preparing materials, and drafting charter application recommendations. 

·       Support the deputy director of authorizing with compiling, analyzing, and tracking all state accountability data provided by the Tennessee Department of Education for Commission schools.

·       Support the director of authorizing and deputy director of authorizing with compiling historical charter school performance data for decisions including, interim reviews, renewals, and plans of correction.

·       Work with the director of authorizing and deputy director of authorizing to coordinate and prepare materials related to the application process of any charter school operating under the Achievement School District that is seeking authorization by the Charter Commission.   

·       Work with the authorizing team to produce an annual performance report of authorized charter schools based on the Charter Commission’s performance frameworks. 

·       Support the Charter Commission staff’s pre-opening process for new charter schools authorized by the Charter Commission.

·       Support the Charter Commission staff’s annual site visits to authorized charter school and coordinate the scheduling and materials for the visit.   

·       Work with the director of authorizing to oversee the document collection process for the State Board’s authorizer evaluation process and support the process to ensure the Commission maintains its responsibilities to be a high-quality authorizer.

·       Support and collaborate with the special assistant to the executive director and director of external affairs to update the Charter Commission website as it relates to authorizing and appeals. 

·       Build and maintain strong relationships with authorized charter schools and both internal and external stakeholders.

·       All other duties as assigned by the director of authorizing.

Qualifications

·       A Bachelor’s degree from an accredited university (required); a Master’s degree is preferred but not required.

Tennessee State Board of Education: Deputy General Counsel

The Tennessee State Board of Education (“State Board”) is seeking a full-time Deputy General Counsel to provide strategic management of the growing educator license discipline team and to support the General Counsel to advise the State Board on legal issues affecting K-12 education policy. The Deputy General Counsel will report directly to the General Counsel and serve as the leader of the license discipline team, focused on the team’s organization and success. Duties will include providing critical support to State Board attorneys to analyze educator misconduct cases and to prepare for administrative hearings and mediations, recommending rule or law revisions regarding license discipline to the General Counsel, and establishing effective and efficient processes for management of license discipline cases. In furtherance of this work, the Deputy General Counsel will be responsible for maintaining and building positive relationships with internal and external stakeholders to amplify and improve the Board’s license discipline work though conducting strategic, quality trainings and outreach with key stakeholders.

In addition, the Deputy General Counsel will support the General Counsel to advise the State Board on K- 12 education policy and laws affecting the State Board’s work, including analyzing and revising State Board rules and policies, representing the State Board in administrative actions, and responding to inquiries from the media and the public regarding State Board actions and policy.

·       Creating and executing on a comprehensive stakeholder engagement plan to educate local school districts, charter schools, private schools, educator preparation providers and other key groups regarding the State Board’s license discipline work. This will involve conducting trainings, developing, and improving upon current resources, and cultivating new relationships to increase the visibility and knowledge of the State Board’s work in this area. Other engagement duties will include:

o   Serving as the main point of contact and leading regular check-ins with the Office of Educator Licensure and Preparation (OELP) within the Tennessee Department of Education to improve inter-agency communication and problem-solving regarding license discipline work.

o   Managing timely responses to media inquiries and public records requests regarding license discipline cases as prescribed under the law.

·       Supporting the General Counsel to advise the State Board on various K-12 education policy issues and laws affecting the State Board’s work, reviewing State Board contracts, advising on ethics and conflict of interest requirements, analyzing, and revising State Board rules and policies, and testifying before legislative committees regarding license discipline work when necessary.

·       Litigating administrative due process and/or declaratory order actions involving the State Board including drafting legal briefs and motions, responding to discovery, etc.

Qualifications

·       Experience litigating administrative, civil, or criminal cases resulting in positive results for clients (experience litigating cases under the Uniform Administrative Procedures Act is a plus).

Position Description:

Minimum Qualifications:

Tennessee State Board of Education: License Discipline Paralegal

The Tennessee State Board of Education (“State Board”) is seeking a full-time paralegal to support the team of attorneys handling educator license discipline cases. The paralegal will provide critical assistance with the case review process by opening misconduct cases reported to the State Board and requesting information from local school districts and others to assist the State Board’s case review process. The paralegal is also responsible for communicating with school districts, educators, and other stakeholders regarding license actions, and manages reporting of cases into state and national databases. This position will report to the Senior Associate General Counsel and will also be responsible for providing administrative support to the State Board’s legal team and larger staff as necessary. Description: The Administrative Service Assistant is a support role for district-level leadership. This role is responsible for managing and disseminating information, organizing and scheduling meetings, note- taking during meetings, supporting directors and employees, completing clerical tasks, and assisting in the daily operation of the office.
